Breathing Space: Debt Advice and What It Means for You

What is Breathing Space?

Breathing Space is a government-supported scheme designed to give people under financial stress temporary relief from creditor action, including enforcement, legal action, and charging interest on debts.

When you enter Breathing Space:

  • All enforcement action (such as visits from enforcement agents, court action, or bailiff visits) must pause.
  • Creditors cannot add interest or fees to your debts during this period.
  • You get time to work with debt advisers to agree on a manageable repayment plan.
  • Standard Breathing Space lasts for up to 60 days.
  • Mental Health Breathing Space lasts for the duration of your mental health crisis plus 30 days after.
  1. Contact a debt advice organisation authorised to provide Breathing Space support.
  2. The adviser will assess your situation and apply for Breathing Space on your behalf if appropriate.
  3. You will receive written confirmation of your Breathing Space status.
  • Breathing Space does not erase or reduce your debts; it only pauses enforcement temporarily.
  • You must engage with your debt adviser and follow the agreed plan after Breathing Space ends.
  • If you ignore or breach the rules of the scheme, your Breathing Space protection may be cancelled.
  • Not all debts qualify for Breathing Space (some secured debts or certain tax debts might be excluded).
